03/12/2024 ORDER re: [700] [701]. The Court's Scheduling Order stands as written. The Receiver is objecting to the claims and therefore shall proceed first before each claimant/attorney. As far as the topic of the arguments, the parties are free to address any topics they want that are raised by the current claims and objections. The parties should be aware, however, that the Court is not going to decide the priority issue in the abstract, that is, it is first going to decide, to the extent the Receiver disputes the validity of any claim at law, whether the claim is legally valid. Only if the Court decides the claim is legally valid will it then proceed to determine the equitable priority issue, and it is possible that determination will not occur until the Court hears objections to the Receiver's proposed plan of distribution when it is submitted. Ordered by Judge Brian M. Cogan on 3/12/2024. (PW)
